Texas is the only state that lets private employers opt out of workers' compensation. These companies are called non-subscribers, and if you're hurt on the job at one of them, you may be able to file a personal injury lawsuit against your employer.
Under Texas law, a non-subscriber employer sued for negligence loses important defenses. It generally can't argue that you were partly at fault, that you assumed the risk, or that a coworker caused the injury. Some employers ask injured workers to sign releases or enroll in company injury plans after an accident. Talk to a lawyer before you sign anything. In most cases, you have two years from the date of injury to file.

Your own policy may help too. Texas insurers must offer personal injury protection (PIP) and uninsured/underinsured motorist (UM/UIM) coverage unless you rejected it in writing. These benefits can pay medical bills and lost wages when the other driver has little or no insurance.

How long do I have to file a personal injury claim in Texas?
For most personal injury cases in Texas, the deadline is two years from the date of the injury. Claims against a city, county or other government entity can have much shorter notice deadlines, so it's important to call as soon as you can.
What should I do after a truck accident in San Antonio?
Get medical care, call the police and get the crash report number, take photos of the scene, and don't give a recorded statement to the trucking company's insurer. Trucking companies often send their own investigators quickly, so call a truck accident lawyer right away.
My employer doesn't carry workers' comp. Can I still recover?
