Product Liability

Reviewed by Marco Crawford, Trial Attorney · Updated September 2026

When a product fails, the people who get hurt are usually the ones who trusted it most: the worker using a machine the way it was designed, the driver whose tire or airbag failed, or the family that bought something for their home.

Texas law allows people injured by defective products to hold manufacturers and sellers responsible. Marco Crawford is a San Antonio product liability lawyer who works with investigators and experts to find out why a product failed and who should be held accountable.

Types of Product Defects

Texas product liability claims generally involve one of three kinds of defects.

  • Design defects

The product was dangerous because of how it was designed, and a safer alternative design was reasonably available.

  • Manufacturing defects

Something went wrong when the product was made, so it differed from the manufacturer's own design.

  • Marketing defects (failure to warn)

The product lacked adequate warnings or instructions about a danger the manufacturer knew or should have known about.

Texas Law

How Texas Product Liability Law Works

Texas product liability law allows people injured by defective products to hold manufacturers responsible, even without proving exactly how the company was careless. The focus is on whether the product was unreasonably dangerous because of its design, how it was made or how it was labeled, and whether that defect caused the injury.

Design defect claims in Texas generally require showing that a safer alternative design existed that would have prevented or reduced the injury without making the product impractical. Manufacturing defect claims focus on a product that didn't match its own intended design, and warning claims focus on missing or inadequate instructions and warnings.

Product cases are technical and often require engineers and other experts. They also have strict time limits, including a two-year deadline for most injury claims and a 15-year limit measured from when the product was sold, with limited exceptions. Preserving the product itself is critical.

Questions

Frequently Asked Questions

Who can be held responsible for a defective product?

Manufacturers are usually the main responsible party. In some situations, sellers and distributors may also be responsible under Texas law.

Do I have to prove the manufacturer was careless?

Texas product liability law focuses on whether the product was defective and caused the injury. The specific proof depends on the type of defect.

How long do I have to file a product liability claim in Texas?

Most product injury claims must be filed within two years of the injury, and Texas also has a 15-year limit measured from when the product was sold, with limited exceptions. Talk to a lawyer as soon as possible.

What if I was using the product at work?

You may have a product liability claim against the manufacturer in addition to any workers' compensation benefits or claims against your employer.

What does it cost to hire Marco Crawford Law?

Nothing up front. We handle product injury cases on a contingency fee, so you pay no attorney fees unless we recover money for you.

What should I do with a product that injured me?

Keep it exactly as it is. Don't repair it, throw it away or send it back to the company. Store it somewhere safe along with the packaging, receipt and manual, and talk to a lawyer.

Does a recall mean I automatically have a case?

No. A recall can be helpful evidence that a product had a problem, but you still need to show the defect caused your injury. Many valid claims involve products that were never recalled.
